The Kathua rape and murder case has left the world in a state of shock, grief, disappointment and anger. The case of an 8-year-old minor being kidnapped, sedated and brutally gang raped over days and then eventually murdered has left us seething with anger.
So now, the cabinet led by Prime Minister Narendra Modi has approved the death penalty for those convicted of raping children up to 12 years.
This ordinance will amend the Evidence Act, the Code of Criminal Procedure (CrPC) and the Protection of Children from Sexual Offences (POCSO) Act under the IPC and a new provision will be introduced to give death sentence for such crimes.

On Friday, the government also informed the Supreme Court that it is actively considering amending the penal law to introduce the death penalty to those convicted of sexually abusing children up to 12 years of age.
The ordinance will now be sent to the President for his signature, following which it will be presented in the monsoon session of Parliament that begins in July.
According to the proposal, the quantum of punishment to the rape convict whether a death penalty or life imprisonment shall vary depending upon the age of the victim.
